Terms of Service

Effective date: June 1, 2026

These Terms of Service ("Terms") govern access to and use of Via Nova Academy ("Via Nova," "we," "us," or "our").

These Terms are a draft and should be reviewed before publication. If a signed agreement with a school or district conflicts with these Terms, the signed agreement controls for that customer.

Eligibility and Authority

You may use Via Nova only if you can enter into these Terms or are authorized by an organization that has accepted them.

If you use Via Nova as a teacher, administrator, school, or district representative, you represent that you have authority to use the service for your classroom or organization and that your use complies with applicable school policies.

If you use Via Nova with students under 13, you represent that your school or district has authorized that use and any school consent required for school-authorized educational use.

Students may use Via Nova only when invited or authorized by a teacher, school, parent/guardian, or other authorized adult.

Accounts

You are responsible for maintaining the confidentiality of your account credentials and for activity under your account. You must provide accurate account information and promptly update it when needed.

Acceptable Use

You may not:

  • Use Via Nova for unlawful purposes.
  • Attempt to access data or accounts you are not authorized to access.
  • Interfere with or disrupt the service.
  • Upload malicious code.
  • Use Via Nova to harass, threaten, or harm others.
  • Attempt to bypass security, enrollment, role, or access controls.
  • Send student PII to AI prompts or image-generation requests.
  • Use exports in violation of school policy or applicable law.

Teacher and School Responsibilities

Teachers and schools are responsible for:

  • Managing class rosters and invitations.
  • Ensuring student information is accurate.
  • Obtaining any required school, parent, or guardian permissions.
  • Using school-approved student accounts, student emails, identifiers, and export destinations.
  • Reviewing AI-generated content before classroom use.
  • Using PII-bearing exports only for legitimate school workflows.
  • Using school-approved destination accounts for official grade/SIS exports.

Student Data

Student data is handled according to the Privacy Policy, Student Data and FERPA Commitments, Data Retention and Deletion Policy, and applicable school agreements.

Via Nova does not sell student data and does not use student data for targeted advertising.

AI Features

Via Nova may provide teacher/admin-only AI features for content generation, such as quiz/test questions and team avatars. Students do not have direct AI access through Via Nova.

AI-generated content may be inaccurate or inappropriate. Teachers must review AI-generated content before using it.

Student PII and education-record data must not be included in AI prompts or image-generation requests.

Google Sheets Exports

Via Nova may allow teachers to export classroom data to Google Sheets. Exported files are controlled by the destination Google account after export. Teachers are responsible for handling exported spreadsheets according to school policy.

Customer Content

You retain ownership of content you submit to Via Nova, subject to the rights needed for Via Nova to provide, secure, support, and improve the service.

You represent that you have the rights and permissions needed to submit content to Via Nova.

Via Nova Content and Software

Via Nova and its software, design, branding, and content are owned by Via Nova or its licensors. These Terms do not grant ownership of Via Nova's software or intellectual property.

Fees and Payment

If paid subscriptions or services are offered, fees, billing terms, renewal terms, and cancellation terms will be provided at purchase or in an order form.

Suspension or Termination

Via Nova may suspend or terminate access if:

  • You violate these Terms.
  • Your use creates security, legal, or operational risk.
  • Payment is not made when required.
  • A school or district requests termination.
  • Continued service would violate law or vendor terms.

Service Changes

Via Nova may update, modify, or discontinue features. We will try to provide reasonable notice for material changes where practical.

Disclaimers

Via Nova is provided on an "as is" and "as available" basis, except as expressly stated in a separate written agreement. We do not guarantee that the service will be uninterrupted, error-free, or suitable for every classroom or school requirement.

Via Nova does not provide legal, compliance, or educational-certification advice.

Limitation of Liability

To the maximum extent permitted by law, Via Nova will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages. Any liability limits in a signed school or district agreement control for that customer.

Changes to Terms

We may update these Terms from time to time. We will update the effective date when changes are made. Continued use after changes means you accept the updated Terms.
